• SORA Modification

  • Resentencing & Early Termination of Supervision

    Due to the enactment of the Domestic Violence Survivors Justice Act in 2019, the court may now consider the lasting and devastating effects of domestic violence on an individual who has been subjected to it.

    The individual must demonstrate the following:

    At the time of the instant offense, the individual was a victim of substantial physical, sexual, or psychological abuse inflicted by a member of the same family or household.

    The abuse was a "significant contributing factor" to the individual's "criminal behavior."

    Considering the nature and circumstances of the crime, as well as the individual's history, character, and condition, the sentence of imprisonment that was or would be imposed is "unduly harsh."

    With sensitivity and respect for the individual, Paraclete Forensic Mitigation's skilled interviews identify any need for additional experts, sources of documentation to support incidents of domestic violence, and contribute to the completion of comprehensive reports in support of the attorney’s resentencing petition under the Domestic Violence Survivors Justice Act.
